Can I fight an auto insurance company, to prevent my car from being declared a total loss, in California?

Its an older car but only has a small dent. I understand that its the value of the car vs their estimate of repairs that they are basing this on, but they didn't include options like A/C, cruise control, power door locks and power mirrors and others when figuring its worth. They instead based it on an average car in my area. When doing the math the difference between fixing the dent and totaling the car came out to $18.00. Clearly the addition of the options would have covered that spread in my favor. I want to fight this because I don't want to have a salvage title. I was not at fault and the other parties insurance has already sent me a check I have not cashed nor have I signed anything. I want to know what I can do. And if I am stuck with the total loss, do I have the right to recover for re-title and re-registration charges and smog fees that are going to add up to a few hundred out of my pocket since I am keeping the car. I like this system because it keeps my employees from quitting, particularly the ones with pre-existing conditions or family members with pre-existing conditions. I can get what I want out of them by using the health-care lasso ( go ahead and quit, but try seeing how much a private policy will cost you if you're lucky enough to get accepted with what you've got! ), plus there is no need to worry about competition from freelancers or small businesses. I like tying benefits to employment because as an employer I have a way of keeping my employees in line. If they act up or talk about branching out into something else, I just have to remind them of where they get their affordable benefits and how they would lose this corporate pool if they were to go out on their own, work for a small business without benefits, work freelance or go back to school full time. one of our cars', 93 Toyota Tercel just got totalled out in a fender bender that was caused by another driver. since we only have collision insurance with AmFam on it, the other woman's company made the pay out to us (~$2K) and let us keep the car. we decided to fix the car up mechanically, and give it a bit of a face lift on the mangled front side fender, but didnt really put too much money into it. so the question is.... as we continue to drive the car, and G*d Forbid, anything similar should happen again, when we are not at fault and there's no bodily damage, just car damage, would we be able to get the other insurance company to pay for the car repairs? or will they say, well, you already had it totalled out once, we're not gotta give you $ to fix a car that not worth much... or how does this work? anyone have any experience with this? anyone here an insurance adjuster? thanks in advance

I find this to be an extremely good deal, but something tells me, when I speak to them, they are not going to honor it. So, do they have to honor their quote? I don't have car insurance, but I have a driver's license. I am 16 years old living in Arkansas and I don't drive much. My parents have insurance and when they added me to the policy (of 2 cars), it went from $150 a month to $350, which we can't afford. We cancelled that insurance (with geico) and now have esurance, where my parents pay $135 monthly (with the same coverage), without me added. Should I be added on the policy, even though I don't drive much? If I'm driving and get in an accident, can I say that I was just burrowing my dad's car? Will I be covered under him then? Is anyone familiar with Texas Department of Health and Human Services. I just found out I am pregnant yesterday, two days ago my husband was laid off work. His old company added an HSA for us in December and we were under the impression everything was fine with employment if they added this for our family. I finally had a family HSA as of 1/1/12 and then on 1/3/12 it was taken away. He worked 90 hours on his last paycheck almost the most of the year, and was told work is slow so he was being laid off. They also added back matching 401k this year too, yep! We have been trying for years and had no idea this would happen this way. It is just crazy! So I found out on the website for HHS of Texas the income level for benefits. I am right there underneath the level for 2 people. Do they include the unborn child as a 3rd family member yet? Also I saw that you have to list assest out like vehicles. We have two cars and that is it. We make payments on both of them, so is it possible they will deny us since we have these assets. Other than those we have no other assets. But I remember my mom being denied for SSI on my brother due to assets so I am worried. Please can anyone help ease my mind?
